Device Buyback Terms and Conditions
Effective Date: July 13, 2026
By submitting a device for buyback through our Device Buyback Program, you ("Seller") agree to the following terms and conditions. Please read them carefully before proceeding.
1. Eligibility
The Device Buyback Program is open to individuals who are the lawful owner of the device being sold. Sellers must be at least 18 years of age or have the consent of a parent or guardian.
2. Device Condition and Accuracy
You represent and warrant that:
- You are the sole and rightful owner of the device.
- The device has not been reported lost or stolen.
- The device is not subject to any lien, lease, or financial obligation.
- All information you provide regarding the device's condition is accurate and complete.
3. Offer and Pricing
Buyback offers are based on the condition, model, and market value of the device at the time of submission. The offer presented is an estimate and is subject to physical inspection upon receipt. If the actual condition differs from what was reported, the final offer may be adjusted or voided.
4. Payment
Payment will be issued via the method selected during checkout (e.g., bank transfer, PayPal, gift card). Processing times vary by payment method. We reserve the right to choose an alternative method if the selected method is unavailable.
5. Device Data and Privacy
You are responsible for removing all personal data from your device before submission. We are not liable for any personal data remaining on a device after it has been received.
6. Rejection of Devices
We reserve the right to reject any device that:
- Has been reported lost or stolen.
- Does not match the described condition.
- Is subject to a carrier lock or activation lock that cannot be resolved.
- Does not meet our minimum quality standards.
If a device is rejected, it may be returned to the Seller at their expense or recycled in accordance with applicable regulations.
7. Shipping and Transit Liability
The Seller is solely responsible for the safe packaging and shipment of any device submitted for buyback. Gadget Groove POS and Refreshed Tech are not liable for:
- Loss, theft, or damage to a device during shipping or transit.
- Delays caused by the carrier or postal service.
- Incorrect or insufficient packaging that results in damage.
- Any costs associated with return shipping of rejected or undeliverable devices.
We strongly recommend using a trackable, insured shipping method. Any dispute relating to a lost or damaged shipment is solely between the Seller and their chosen carrier.
8. Facilitation Fee & Role of Gadget Groove
Gadget Groove POS acts solely as a facilitator between you (the Seller) and Refreshed Tech, the third-party buyback platform that purchases your device. Gadget Groove POS does not directly purchase your device.
In consideration for facilitating the transaction, Gadget Groove POS retains a 3% service fee of the total buyback offer value.
9. Limitation of Liability
To the fullest extent permitted by law, Gadget Groove POS shall not be liable for any indirect, incidental, or consequential damages arising from participation in this program. Our total liability shall not exceed the offer value of the device in question.
10. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Continued participation in the buyback program following any changes constitutes acceptance of the new terms.
11. Governing Law
These terms are governed by the laws of the jurisdiction in which our business operates, without regard to conflict of law principles.
